Environmental and planning law
Prerequisite
– 122 Introduction to the common law

Urban and
environmental themes. Historical evolution of controls; emergence
of public health, housing, planning and environmental codes. The
question of land values. Nuisance law, environmental pollution and
the planning system.

The environmental
and planning framework. Governmental agencies concerned with
environmental protection. Development plans: structure plans, local
plans, unitary plans.

The control
of development. The concept of development: two limbs, GDO,
UCO, intensification, abandonment, established uses, the planning
unit. Control procedures: applications, fees, certificates, environmental
assessment, publicity, development by local authorities, statutory
undertakers and the Crown, processes of determination within the
authority, estoppel and civil liability. The regulation of development
(i) material considerations, (ii) conditions, (iii) planning gain/obligations.
Appeals, Inquiries and Review. Enforcement.

and the environment. Special controls: listed buildings, conservation
areas, trees, advertising, hazardous substances, minerals, ancient
monuments; waste; nature conservation.

control. Integrated pollution control. Atmospheric pollution.
